You must read these Terms carefully before you apply for and use your Duty Zero by cdf Membership Card. These Terms contain important information, including limitations of liability.

  1. Introduction
    1. This document is known as the Duty Zero by cdf  Membership Program Terms (“Terms”).
    2. This document sets out the terms and conditions of the Duty Zero by cdf Membership Program, which is an independent membership program provided by CDF-LAGARDERE COMPANY LIMITED exclusively in Hong Kong.
    3. The Terms will apply to you as a Member on and from your first use of your Membership Card.
  2. Definitions

    In these Terms:

    Affiliate means a business affiliated with Duty Zero by cdf, as advised by Duty Zero by cdf from time to time on its website.

    Application Form means the application form required to be completed by you at specific Duty Zero by cdf Stores in order to become a Member.

    Benefits means the facilities, services, products, discounts, offers, activities and events or arrangements offered or available to Members from time to time through or in conjunction with the Duty Zero by cdf Membership Program.

    CDF-LAGARDERE COMPANY LIMITED means a company incorporated in Hong Kong, whose registered office is at Unit 207&208,2/F Regal Airport Hotel, 9 Cheong Tat Road, Chek Lap Kok, Hong Kong (“CDFL” or “Duty Zero by cdf”).

    Dollar or $ means Hong Kong dollars.

    Duty Zero by cdf Customer Service Team means the customer service team established by Duty Zero by cdf where Shopping Points Account information is processed and enquiries are handled. The email is customerservice@dutyzero.com.hk.

    Duty Zero by cdf Membership Program means the program called “Duty Zero by cdf” operated by Duty Zero by cdf in which members earn Shopping Points and other Benefits.

    Eligible Transaction is a transaction where your Membership Card is scanned for:

    1. the purchase of goods from a Duty Zero by cdf store at Hong Kong International Airport, excluding purchases using gift cards or vouchers, purchases of tobacco, purchases of gift cards and vouchers, non-merchandise donations and delivery charges; and purchase of goods from a Duty Zero by cdf store at Hong Kong International Airport (“HKIA”), excluding purchases using gift cards or vouchers or purchases enjoying HKIA staff discount, purchases of tobacco, purchases of gift cards and vouchers, non-merchandise donations and delivery charges; and
    2. other transaction types which Duty Zero by cdf notifies you of from time to time.

     

    Member means a member of the Duty Zero by cdf Membership Program.

    Membership means being a Member of the Duty Zero by cdf Membership Program.

    Membership Card means any membership card or temporary membership card issued by Duty Zero by cdf to you that is linked to your Shopping Points Account, whether in a plastic, electronic (virtual) or other form.

    Membership Tier Period means three (3) calendar years, starting from the next day after such person becomes a Member or the next day when such member’s Tier has upgraded or degraded according to Clause 4 of these Terms and ending on the third (3rd) anniversary of the forgoing date.

    PICS means the Private Information Collection Statement published on the Duty Zero by cdf website.

    Qualified Spend means minimum spends of a Member to keep him or her on a Membership tier during one Membership Tier Period as below:

    Basic Members any spend
    Silver  Members $5,000
    Gold  Members $10,000
    Platinum Members $50,000
    Diamond Members $100,000

    Shopping Points means the points earned by you in accordance with these Terms.

    Shopping Points Account means the program account held by Duty Zero by cdf in a Member’s name. If you are a Member, the Shopping Points Account details the number of Shopping Points.

    Spend means a Member’s spend on each Eligible Transaction.

    You or your is a reference to the individual in whose name the Shopping Points Account is held.

    Website means dutyzero.com.hk, or any other sites as notified by Duty Zero by cdf from time to time.

  3. Your Participation and Membership Card
    1. Participation in the Duty Zero by cdf Membership Program is open to natural persons of at least 18 years old and full legal capacity.
    2. Membership Card will be issued to you on conditions that (i) Duty Zero by cdf has received the duly completed application documents, including the application form and the written consent to PICS, and (ii) the application documents are approved by Duty Zero by cdf. Duty Zero by cdf may accept or reject any Application Form at its sole discretion.
    3. If you do not agree to be bound by these Terms, please do not use your Membership Card and notify Duty Zero by cdf, by writing to Duty Zero by cdf Customer Service Team.
    4. By using your Membership Card, you agree to the collection, use and disclosure of your personal information in accordance with the PICS, as amended from time to time.
    5. Shopping Points will not be awarded until these Terms have become binding on you.
  4. Membership
    1. Membership is tiered according to your Spend at Duty Zero by cdf when you are shopping and using your Membership Card:
      1. Members have spent at Duty Zero by cdf but have not spend enough to be tiered as Silver;
      2. Silver Members have spent between $5,000(inclusive) and$10,000;
      3. Gold Members have spent  between $10,000(inclusive) and$50,000;
      4. Platinum Members have spent  between $50,000(inclusive) and $100,000; and
      5. Diamond Members have spent $100,000 or more.
    2. Your first spending at Duty Zero by cdf stores shall not be calculated as the Spend to reach/ keep your Membership tier.
    3. The Spend shall be cleared at the beginning of each Membership Tier Period.
    4. Membership tier shall be upgraded within three (3) days after your Spend reaches the Qualified Spend of relevant Membership tier until the end of such Membership Tier Period, provided that the aggregate Spend shall be reset after such upgrade. Shopping Points multiplier will apply after the member tier is upgraded. For the avoidance of doubt, you shall not be entitled to the relevant Benefits for such tier until the system indicates that you have reached such tier.
    5. If your Spend at the end of a Membership Tier Period reaches relevant Qualified Spend of the Membership Tier, you could keep your Membership Tier till the end of next Membership Tier Period. If your Spend at the end of a Membership Tier Period does not reach the Qualified Spend of relevant Membership Tier, your Membership tier will be downgraded to the immediately lower tier for the next Membership Tier Period.
    6. If you are a Basic Member and you have made no Spend during any Membership Tier Period, immediately starting from next Membership Tier Period, your Membership Card will be frozen and you will not be entitled to the Benefits as a Duty Zero by cdf Member until you make a Spend to activate your Membership Card.
    7. All Members will be assigned a Membership number. This number will be used for identification purposes.
    8. Membership Card is not debit, or credit card, is not transferable, for cardholder use only and remains the property of Duty Zero by cdf. 
    9. Duty Zero by cdf can (but not obligated to) require the holder of Membership Card to show his/her identification documents, including but not limited to the Hong Kong Identification Card or Passport, for inspection. 
    10. You must advise Duty Zero by cdf of any change of name, address, or other details as soon as practicable after the change. Duty Zero by cdf is not responsible for any failure by you to notify Duty Zero by cdf of the change which may result in any loss. Duty Zero by cdf may require acceptable proof in relation to any change of details.
  5. Shopping Points
    1. You  may:
      1. earn Shopping Points by presenting your Membership Card:
        1. on each Eligible Transaction in accordance with these Terms; or
        2. as a result of promotional or incentive programs offered by Duty Zero by cdf from time to time, provided that rights relating to such Shopping Points may be limited at Duty Zero by cdf’s sole discretion. Currently, Duty Zero by cdf offers double Shopping Points on each Eligible Transaction in your birthday month, which is provided by you when you signed the Application Form. 
          Double Shopping Points on each Eligible Transaction in your birthday month is offered every year. If you do not provide your birthday month information at registration, you can provide information by contacting Customer Service team anytime after so that you can enjoy double Shopping Points on each Eligible Transaction in your birthday month in the future; If you do not provide your birthday month information at registration until after you purchase at Duty Zero in your birthday month, application of Double Shopping Points on each Eligible Transaction in your birthday month will not be accepted.

      For each Eligible Transaction, you will earn Shopping Points only after you have made a purchase, based on the table below:

      Shopping Points allocated in relation to each Eligible Transaction are usually added to your Shopping Points Account within three (3) days after such Eligible Transaction. If not, you may contact us to add such Shopping Points within 180 days after the Eligible Transaction, provided that you shall present the evidence to prove such Eligible Transaction. For the avoidance of doubt, you shall not be entitled to redeem such Shopping Points until your Shopping Points Account indicates that you have such Shopping Points.

    2. Shopping Points will expire on the earlier of (i) the third (3rd) anniversary date from the date such Shopping Points accumulated in your Shopping Points Account; (ii) when the Membership expires; or (iii) when the Membership is cancelled.
    3. Shopping Points are not property and have no cash or monetary value.  Shopping Points can only be used for redemption pursuant to Clause 6. .
    4. Shopping Points and your rights under these Terms cannot be sold, transferred and/or assigned. Shopping Points can only be used by cardholders only.
    5. Shopping Points may be deducted if Duty Zero by cdf reasonably believes that the Shopping Points were earned:
      1. fraudulently, or Duty Zero by cdf reasonably suspects they were earned fraudulently; or
      2. by reason of engaging in inappropriate conduct that undermines the legitimate interests of Duty Zero by cdf.
    6. Duty Zero by cdf may deduct from your Shopping Points Account any Shopping Points that have been pointed to your Shopping Points Account in error or as a result of an error, as well as any Shopping Points which relate to transactions which has been cancelled or reversed.
    7. Shopping Points can only be earned by Members for their own personal shopping. Shopping Points cannot be earned on purchases of commercial quantities of goods or services, or any purchases which are for a commercial purpose including the resale of goods, as determined by Duty Zero by cdf. What will constitute a commercial quantity may depend on the type of product purchased. Duty Zero by cdf may review and adjust the allocation of Shopping Points at any time.
  6. Shopping Points Redemption
    1. You can, by presenting your Membership Card, trade your Shopping Points for:
      1. redemption, provided that the minimum Shopping Points for redemption are ten (10) points, based on 1 Shopping Point which equals to $1when you shop duty free goods at Duty Zero by cdf stores, which sum will be adjusted at payment over the counter from the price payable;
      2. gifts for Members on special Duty Zero by cdf promotions  held by Duty Zero by cdf from time to time; or
      3. services for Members provided by Duty Zero by cdf from time to time.

      Such redemptions, gifts or services exchanged from the Shopping Points shall not incur any Shopping Points nor can be returned or replaced.

    2. Duty Zero by cdf will deduct the corresponding number of Shopping Points from your Shopping Points Account to the value of such services.
  7. Exchange and Return Policies
    1. Subject to applicable exchange policies of Duty Zero by cdf and subject to Duty Zero by cdf’s satisfaction of the good conditions of the goods, you may exchange the goods purchased on an Eligible Transaction within 180 days after the purchase of such goods for other goods with equal or higher price. You shall be required to pay the difference in price (if any) and such amount shall be counted as your Shopping Points and Spend.
    2. Duty Zero by cdf does not accept returns of goods that are purchased on an Eligible Transaction.
  8. Other Benefits and Special Promotions
    1. The current features and Benefits of the Duty Zero by cdf Membership Program are described at dutyzero.com.hk. Duty Zero by cdf may notify you from time to time of additional websites that set out features or Benefits of the Duty Zero by cdf Membership Program.
    2. Duty Zero by cdf will specify promotions, advertisements or any other events or news by notice via email, SMS, or in the relevant Duty Zero by cdf stores. Terms specific to such promotions or advertisement may include such details relating (but not limited) to: the eligible purchases; the period during which an eligible purchase must be made for it to be the subject of the special promotion; and the length of the relevant special promotion term.
    3. If Duty Zero by cdf invites you to a special event, you may present the relevant Membership Card to gain admission or any applicable discount.
    4. Duty Zero by cdf may from time to time permit the redemption of Shopping Points for rewards. Duty Zero by cdf will notify you of these rewards.
    5. From time to time Duty Zero by cdf may send you offers in conjunction with other loyalty programs, or from business partners or Affiliates.
  9. Lost or stolen Membership Cards
    1. You must notify the Duty Zero by cdf Customer Service Team immediately if your Membership Card is lost or stolen.
  10. Duty Zero by cdf Membership Program Changes
    1. Duty Zero by cdf may at any time make any changes to the Terms at its sole discretion, including but not limited to changes to rules governing: Shopping Points and the expiry of Shopping Points, provided that Duty Zero by cdf shall post such changes on its website within a reasonable time limit.
  11. Termination and Transfer
    1. Duty Zero by cdf may in its discretion, suspend or terminate the participation by you in the Duty Zero by cdf Membership Program, if Duty Zero by cdf reasonably believes that you have:
      1. breached these Terms;
      2. engaged or may engage in fraudulent conduct, or conduct that is suspected to be fraudulent, in relation to your Shopping Points Account or in a claim for allocation of Shopping Points; or
      3. engaged or may engage in inappropriate conduct that undermines the legitimate interests of Duty Zero by cdf or its Affiliates (e.g. theft from a Duty Zero by cdf store).
    2. Where Duty Zero by cdf intends to terminate your participation in Duty Zero by cdf Membership Program, Duty Zero by cdf will provide you with written notice of such termination and you will have 14 days to rectify the breach (where possible) and/or advise Duty Zero by cdf in writing as to why your participation should not be terminated. Duty Zero by cdf will review any response you provide and will advise you of its decision. Duty Zero by cdf may, at its discretion, cancel all or any Shopping Points that have been issued to you if your right to participate in the Duty Zero by cdf Membership Program is suspended or terminated.
    3. You may terminate your participation in the Duty Zero by cdf Membership Program at any time by giving Duty Zero by cdf notice by writing to Duty Zero by cdf (including email).On receiving notification of termination from you, your Shopping Points Account will be recorded on the Duty Zero by cdf database as closed. You will cease to earn or use Shopping Points.
  12. General Information
    1. The execution, validity, interpretation and exercise of these Terms and the resolution of any disputes hereunder and under the PICS shall be governed by the laws of the Hong Kong Special Administrative Region of the People’s Republic of China.
    2. You are solely responsible for any government tax, duty or other charge imposed by law in any country in respect of the Duty Zero by cdf Membership Program, your participation in the Duty Zero by cdf Membership Program, any Shopping Points earned or any other transaction within the Duty Zero by cdf Membership Program.
    3. Any failure or delay by Duty Zero by cdf in exercising its rights under these Terms does not constitute a waiver of those rights.
    4. Except as provided in any law which cannot lawfully be excluded or modified by agreement, Duty Zero by cdf does not accept any liability whatsoever including for negligent acts and omissions, with respect to:
      1. the breach of any of these Terms or any term implied by law (including statute) by any person other than Duty Zero by cdf;
      2. Shopping Points or any other reward or Benefit;
      3. any death or injury or consequential loss or damage arising from the supply of reward or Benefit;
      4. the loss, theft or destruction of any other Benefit;
      5. any delay in replacing a Membership Card or unauthorised use of a Membership Card; and
      6. any failure, delay or inability to provide a Membership Card or other Benefit to you caused by circumstances beyond its control, including strikes or industrial disputes, acts of God, flood, weather, war or civil disturbance.
    5. Duty Zero by cdf may give you notice by advertisement in a newspaper circulating throughout Hong Kong, online, in writing by post.
    6. Where Duty Zero by cdf gives you notice by post, you agree that, unless otherwise stated in these Terms, the notice is deemed to have been given to you (as the case may be): on the date of actual receipt of the notice or on the date it would have been delivered in the ordinary course of post, whichever occurs first; provided it is sent to the last known address Duty Zero by cdf has for you in connection with the Duty Zero by cdf Membership Program.
    7. These Terms are written in both English and Chinese (simplified Chinese and traditional Chinese). In case of discrepancies between the English and Chinese versions of the Terms, the English version shall apply and prevail.
    8. The decision of Duty Zero by cdf in interpreting these Terms shall be final.
